Kinzy London Terms and
Conditions

1. About us

Kinzy London is the trading name of MyKinzy Ltd, a company registered
in England and Wales under company number 13748043. Our registered
office is 115 Fencepiece Road, Ilford, England, IG6 2LD. Our showroom is
at 7 Greville Street, London EC1N 8PQ.

These Terms and Conditions apply to your use of kinzylondon.com and
to purchases made online, by telephone, in our showroom or through an
individually agreed quotation. Our Privacy Policy,
Delivery & Returns policy and,
where applicable, our Bespoke Purchase Agreement
also form part of your agreement with us.

Nothing in these terms limits your statutory rights.

2.
Jewellery expertise, product information and natural variation

We take care to describe our jewellery, diamonds and gemstones
accurately. Product photographs, videos, renders and colours may appear
differently depending on lighting, magnification and screen
settings.

Natural diamonds and gemstones are individual products of nature.
Variations in colour, tone, saturation, clarity, inclusions, carat
weight and dimensions are natural characteristics and do not, by
themselves, mean that an item is faulty or misdescribed.

Where information is available, we will disclose treatments or
enhancements communicated to us by the supplier. Diamonds may be
supplied with reports from recognised laboratories such as GIA or IGI
where stated. Not every gemstone is supplied with an independent
laboratory report.

The weight, dimensions and other specifications shown on the website
or in a quotation may be approximate unless we confirm that they relate
to a particular certified stone.

3.
Ready-to-wear, made-to-order and bespoke jewellery

We use these descriptions carefully:

  • Ready-to-wear means an item that is already completed and available
    for dispatch or collection.
  • Made-to-order means an existing Kinzy London design that is
    manufactured after you order it. A standard made-to-order item is not
    automatically bespoke or personalised.
  • Bespoke or personalised jewellery means an item designed, sourced,
    engraved, resized, altered or manufactured to your individual
    specifications, including an item incorporating a diamond or gemstone
    selected and allocated specifically to your commission.

Website orders do not include the bespoke CAD, wax-modelling or
stone-replacement service unless we expressly agree this with you in
writing.

4. Placing an order
and forming the contract

When you place an online order, you are offering to buy the item
subject to these terms. An automated email acknowledging the order does
not by itself mean that we have accepted it. The contract is formed when
we confirm acceptance, confirm dispatch or begin work with your
agreement, whichever happens first.

For a bespoke or individually quoted order, the contract is formed
when you approve the written quotation or order details and we receive
the agreed deposit or payment.

We may decline or cancel an order before acceptance if, for example,
an item or stone is unavailable, a price or description contains an
obvious error, payment is not authorised, the delivery address cannot be
served, or we reasonably suspect fraud or misuse. If we cancel after
receiving payment, we will refund the amount paid unless a bespoke
service or specifically commissioned work has already begun under an
agreed Purchase Agreement.

You are responsible for checking the design, metal, measurements,
ring size, engraving, stone specification, delivery address and other
order details before confirming the order.

5. Prices, VAT and payment

Website prices are shown in pounds sterling and include UK VAT unless
stated otherwise. Delivery charges, international shipping charges,
customs duties or other costs will be shown or agreed separately where
applicable.

Diamond, gemstone, precious-metal and currency markets can change
quickly. Unless a quotation states another validity period, an
individually prepared quotation is valid on the day it is issued. Once
we receive the agreed deposit, the quoted price becomes binding for that
specific item unless you request a change to the design, materials or
stone specification.

If a website price or quotation contains an obvious error, we will
contact you before accepting the order. You may accept the corrected
price or cancel for a full refund if no bespoke or specifically
commissioned work has begun.

Online card payments are processed securely by our payment provider.
We do not store full payment-card details on the Kinzy London
website.

6. Bespoke
deposits, design and stone sourcing

A minimum deposit of 50%, or another amount agreed in writing, is
normally required for a bespoke or individually sourced order. The
remaining balance must be paid before collection or dispatch.

The Bespoke Purchase Agreement supplied with your commission sets out
the detailed design, CAD, wax-model, stone-viewing, replacement,
valuation, warranty and payment conditions. Unless we agree otherwise in
writing:

  • Two complimentary CAD renders are included.
  • Up to two complimentary wax models of the final approved CAD design
    are included.
  • Additional CAD renders cost GBP 100 each.
  • Additional wax models cost GBP 60 each.
  • Up to two complimentary diamond replacements are allowed during the
    agreed viewing period; a third or later replacement costs GBP 150 per
    diamond.

Changes to the design, materials, measurements or selected stone may
require a revised quotation and completion estimate.

Once a bespoke or personalised order has been commissioned and the
agreed deposit or payment has been received, it cannot normally be
cancelled or returned because you have changed your mind. This reflects
the individual nature of the work and the cancellation exception for
goods made to a consumer’s specification or clearly personalised. Your
rights remain unaffected if the item is faulty or misdescribed.

7. Availability and
substitute stones

Diamonds and gemstones remain subject to availability and supplier
confirmation until reserved. If a selected stone becomes unavailable
before it is secured, we will explain the position and may offer a
comparable alternative. We will not substitute a material, diamond or
gemstone without your approval.

Rare or unique stones may be non-returnable or non-exchangeable under
supplier terms. We will tell you before ordering when this applies.

8. Production times

Ready-to-wear, made-to-order and bespoke items have different
completion times. The estimated timing shown on a product page, in an
order confirmation or in a quotation is an estimate rather than a
guaranteed delivery date unless we expressly agree a fixed date in
writing.

We aim to complete and dispatch Kinzy London orders within
approximately three weeks where this estimate is shown, but bespoke work
or specialist stone sourcing may take longer. We will keep you informed
if material availability, design changes, supplier schedules, customs,
courier disruption or another event outside our reasonable control
affects the estimate.

9. United Kingdom
and international delivery

United Kingdom delivery by Royal Mail Special Delivery is
complimentary, insured and tracked. Tracking information is provided
when the order is dispatched. We may require a signature, proof of
identity or another reasonable security check before releasing or
delivering a high-value order.

International delivery by FedEx is available where we agree to serve
the destination. Charges depend on the destination and order. Unless we
confirm otherwise in writing, the recipient is responsible for local
taxes, customs duties, import fees and any information required by
customs authorities.

Please check the delivery address carefully. We cannot redirect a
parcel after dispatch where the carrier or insurance arrangements do not
permit it.

Risk passes to you when the item is delivered to you or to a person
you have identified to receive it. Ownership passes when we have
received payment in full.

10. Showroom collection

Collection from our Hatton Garden showroom is complimentary. We will
contact you when the order is ready. Please bring your order
confirmation and photographic identification.

If another person is collecting for you, you must give us written
authorisation before collection and they must bring photographic
identification.

Completed orders and repairs should be collected within 60 days after
we notify you unless we agree another arrangement in writing.

11. Eligible online returns

For an eligible, non-personalised item purchased online, tell us
within 14 days after delivery if you wish to cancel. You must then
return the item within 14 days after telling us. The item must be
unworn, unused and returned with its original packaging, certificates,
hygiene seal and proof of purchase.

Contact us before returning jewellery so that we can confirm
eligibility and provide secure return instructions. Do not send
jewellery until we have confirmed the return method and address.

You are responsible for the cost and risk of a change-of-mind return.
We strongly recommend an insured and tracked service suitable for fine
jewellery. An eligible item may also be returned to our showroom after
we have confirmed the return.

We will issue an eligible refund within 14 days after receiving the
returned item, or after you provide evidence that it has been sent back
if the law requires us to refund earlier. We may reduce a refund where
handling beyond what is reasonably necessary has reduced the item’s
value.

12. Items
that cannot be returned for change of mind

The change-of-mind cancellation right does not apply to jewellery
made to your specification or clearly personalised, including engraved,
specially resized, altered or bespoke items and stones sourced and
allocated specifically to your commission.

Earrings bought online may be returned within the eligible return
period only while the protective hygiene seal remains intact. Earrings
cannot be returned for change of mind after the seal has been
opened.

These exclusions do not affect your statutory rights if an item is
faulty, damaged or misdescribed.

13. Missing,
damaged, faulty or misdescribed items

If a parcel is missing or the packaging or jewellery appears damaged,
contact us as soon as possible and retain the packaging. Photographs may
help us investigate the issue with the carrier, but a delay in
contacting us does not remove your statutory rights.

Goods must be of satisfactory quality, fit for purpose and as
described. If an item is faulty or misdescribed, we will provide the
repair, replacement, price reduction or refund required by applicable
consumer law.

14.
Lifetime manufacturing warranty and Atelier Care

Qualifying Kinzy London jewellery includes a lifetime manufacturing
warranty for craftsmanship and the Lifetime Atelier Care stated in your
order documents and aftercare policy. This warranty is additional to
your statutory rights.

The warranty does not cover accidental damage, impact, misuse,
neglect, loss, normal wear, a loose earring fastening caused by wear, or
work carried out by an unauthorised third party. Silver items are not
covered by the lifetime manufacturing warranty or Lifetime Atelier
Care.

To maintain the lifetime manufacturing warranty for a ring, the ring
must receive a Kinzy London structural inspection and service within 12
months of the original purchase date and every 12 months afterwards.
Please refer to the Lifetime Atelier Care page and your Purchase
Agreement for the service inclusions and exclusions.

15. Promotions and discount
codes

Promotions and discount codes are subject to the conditions displayed
with the individual offer, including any closing date, eligibility rule,
product exclusion or usage limit.

Only one promotion or discount code may be used per order. Offers
cannot be combined. A promotion cannot be exchanged for cash, applied
retrospectively or transferred unless the individual offer expressly
says otherwise.

If a promotional condition conflicts with these general terms, the
specific condition displayed with that promotion applies to the
promotion only. Your statutory rights are unaffected.

16. Website accounts and
acceptable use

You may be required to create or use an account to place an order.
You are responsible for providing accurate information, keeping your
account details secure and telling us promptly if you believe the
account has been used without permission.

You must not misuse the website, attempt unauthorised access,
introduce malicious code, interfere with the service, scrape protected
data unlawfully or use Kinzy London content for an unlawful purpose.

The Kinzy London name, branding, jewellery designs, photographs,
videos, graphics and website copy belong to us or are used under
licence. You may view and print website content for personal,
non-commercial use. You may not reproduce or commercially exploit it
without written permission.

The website may link to third-party websites or services, including
appointment, review, payment, delivery or social platforms. We are not
responsible for third-party content or services that are outside our
control, but this does not affect our responsibility for fulfilling your
order.

18. Liability

We are responsible for losses that are a foreseeable result of our
breach of these terms or our failure to use reasonable care and skill.
We are not responsible for business losses arising from a consumer
purchase or for a failure caused by an event outside our reasonable
control.

Nothing in these terms excludes or limits liability where it would be
unlawful to do so, including liability for fraud, death or personal
injury caused by negligence, or your statutory consumer rights.

19. Privacy

We use personal information as described in our Privacy Policy.
Payment providers, carriers and other service providers may process
information where necessary to take payment, prevent fraud, fulfil an
order or deliver jewellery.

20. Changes to these terms

We may update these terms from time to time. The terms that apply to
your purchase are those in force when the contract is formed, together
with any written quotation, order confirmation or Purchase Agreement
agreed with you. A later change will not retrospectively alter an
existing order unless the change is required by law or you agree to
it.

21. Governing law and
complaints

These terms are governed by the laws of England and Wales. The courts
of England and Wales will have jurisdiction, without depriving a
consumer of mandatory rights or protections available where they
live.
